App rejected because 3G streaming - HELP

My app got rejected because I allow video streaming over cellular network.
But I saw lots of app in the AppStore that do the same!!
It's just because I had bad luck with the reviewer and he decided to reject it?
If I put a toggle to enable/disable 3g streaming will my app be accepted?
Or what do I need to do?
