OS 4.0

Sorry a little confused on this one. Are Apple saying that all NEW apps have to be built using SDK 4.0 but you can still target say 3.1.2 and above? The reason I ask is that we've got a new App and as we all know 4.0 is cr@p on a 3G phone (our App slows done a lot - tap a tableview .. and wait!), so I want to make sure that 3G users that still have 3.1.2/3.1.3 (which I guess are alot!) can still use the App.
