If the CONTRACT states that Apple should pay developers for applications sold on the AppStore no later than 45 days after the end of the month of sales and Apple doesn't - guess what? They are in BREACH OF CONTRACT! One can sue in a court of law about this - really. Get an education.
I find the entire arrogant fan-boy attitude of some to be way, way over the top. 'Apple can do no wrong'. 'You'll get your payment *eventually*'.
Um, if Apple, in their OWN contract (to which you MUST agree) fails to comply to that contract - you can SUE them in COURT for DAMAGES. Um, even after they correct the problem. The breach of contract doesn't go away just because they eventually 'fixed' it.
I say that if the situation even comes close to occuring again - class action lawsuit asap.
Apple needs a hard, bruising, lead-boot kick to the head to avoid droves of developers abandoning their little shell game. I'm simply paying lip-service at the moment. They can suck my c*ck for all I'm concerned. I have real paying gigs where I don't have to bend over and take it up the *** for naught...
I dunno if this counts as something against apple, but I just had to agree to the updated Paid Agreement in order to log in.
That is, without accepting a new agreement, I was unable to:
View Sales,
Update App Descriptions, Adjust Pricing
etc etc.
Now surely this undermines the contract signing process since in order to view sales from the old contract, you need to agree to the new contract.
I'm no lawyer but it just seems odd to me.
I believe you are right because we all had to pay a $99 fee and all had an original contract. You can't simply force a new contract on someone after one has been made and not let someone do it because they don't want to agree.
Let's face it, as long as Apple thinks they can push Developers around, the iPhone will suffer.
